We want ordering from Fusion Valley Kitchen to be simple and clear. Here’s a quick summary of how things work. For the full details, please read our official Terms & Conditions further down this page.


Ordering & Payment

  • You can order online from our website.
  • We only deliver to addresses on the UK mainland.
  • Payment must be made in full before we dispatch your order.
  • We accept all major debit and credit cards.

Delivery

  • Orders are usually delivered on the agreed day and should arrive by 8pm the day after dispatch.
  • If you’re not home, we may leave your order with a neighbour or in a safe place (including your doorstep).
  • Our meals are delivered frozen. Minor defrosting in transit is normal. Fully defrosted meals should be eaten within 48 hours and must not be refrozen.

Changes & Cancellations

  • If you want to change or cancel your order, please let us know by 10am on the day of dispatch.
  • Once meals have been processed and packed, we cannot accept cancellations or returns (because our food is perishable).

Allergens & Ingredients

  • Our meals are prepared in a kitchen where allergens are present. We cannot guarantee they are 100% free from traces.
  • Common allergens we handle include: gluten, nuts, peanuts, sesame, milk, eggs, soya, mustard, celery, fish, crustaceans, and sulphites.
  • Please always check our ingredient and allergen information before ordering or eating.
  • If you have allergies or dietary requirements, contact us before placing your order.

Problems or Complaints

  • If something isn’t right, please contact us straight away:

Refunds

  • Refunds are only available if:
    • we cannot accept your order,
    • your delivery is significantly delayed by us, or
    • there is a serious issue with your order.
  • Refunds are made to your original payment method.

Liability

  • We are responsible if we cause foreseeable loss or damage by not taking proper care.
  • We are not responsible for losses we couldn’t have expected, or if our food is used for business or resale purposes.

Privacy

  • We only use your personal details to process your order and, if you opt in, to send you information about our products.
  • We will never sell your details to third parties.

Terms and Conditions

These terms and conditions (together with the documents referred to within) (the “Terms”) apply to your use of the Fusion Valley Kitchen website, trading as Fusion Valley Kitchen, available at www.fusionvalleykitchen.com. By accessing this website and/or placing an order for any of our products (“Products”), you agree to be bound by these Terms. Please read them carefully.

Certain areas of this website may only be accessible if you register. By using this website, you confirm that you accept these Terms regardless of whether or not you choose to register. If you do not agree to these Terms, you may not use or access this website.

This website is owned and operated by Cych Valley Food, a company registered in the United Kingdom with its registered office at Park Villa, Capel Iwan, Newcastle Emlyn, Carmarthenshire, SA38 9NA (“we”, “our”, or “us”).


1. Our Contract with You

1.1. We will accept your order once we have received full and cleared payment, at which point a binding contract will come into existence.
1.2. If we are unable to accept your order, we will inform you and you will not be charged. Reasons may include the Product being out of stock, unexpected limits on our resources, or our inability to meet your requested delivery date.
1.3. We only sell and deliver Products within the UK mainland. We do not currently accept orders from, or deliver to, addresses outside this area.


2. Our Products

2.1. Products may vary slightly from their pictures. Images on our website are for illustrative purposes only. While we make every effort to display content, size and colours accurately, we cannot guarantee that a device’s display reflects the exact appearance of the Products.
2.2. Packaging may vary from that shown on our website.


3. Your Right to Make Changes

If you wish to amend your order, please contact us by 10am on the day of dispatch. If changes are possible, we will confirm any impact on price, delivery, or timing and ask you to confirm before proceeding. If changes are not possible, you may end the contract if Products have not yet been dispatched (see Clause 6).


4. Minor Changes to Products

We may make minor changes to Products to reflect changes in law or regulatory requirements.


5. Providing the Products

5.1. Delivery costs will be displayed on our website at the time of purchase.
5.2. We aim to deliver on the agreed day. Orders should arrive by 8pm the day following dispatch (see 5.3).
5.3. We are not responsible for delays outside our control. If delays occur, we will contact you. If there is a risk of substantial delay, you may end the contract and receive a refund for Products not received.
5.4. If no one is home, we may deliver to a neighbour or leave the Products in a safe place (including your doorstep). We will notify you of where the Products have been left.
5.5. Our Products are perishable frozen food. They are packaged to remain frozen until the evening of the delivery day. Minor defrosting is acceptable; however, if you believe Products have fully defrosted, please take a photo immediately and contact us. Fully defrosted Products must be consumed within 48 hours and should not be refrozen.
5.6. You may treat the contract as ended immediately if:

  • we have refused to deliver; or
  • you informed us at the time of order that delivery within a set timeframe was essential.
    5.7. Responsibility for the Products passes to you upon delivery to your address, neighbour, or safe place (as per 5.4).
    5.8. Ownership of Products passes to you once full payment has been received and delivery completed.
    5.9. We may suspend supply if:
  • we need to deal with technical issues;
  • legal or regulatory changes require us to; or
  • you request changes (see Clause 3).
    5.10. If we suspend supply, we will inform you unless the issue is urgent. You may end the contract if suspension continues (see Clause 6).
    5.11. We may suspend supply if you fail to pay in full.

6. Your Right to End the Contract

6.1. You may end your contract at any time. However, no refund will be given once Products have been processed and packed, due to their perishable nature.
6.2. Under the Consumer Contracts Regulations 2013, most goods bought online can be returned within 14 days. However, this right does not apply to perishable food Products.
6.3. You may cancel at any time up until we process and pack your order for delivery.


7. How to Cancel an Order

7.1. To cancel, please contact us by:

    7.2. Refunds (where applicable) will be made using your original payment method.

8. Our Right to End the Contract

8.1. We may end the contract if you:

  • fail to make payment; or
  • fail to provide necessary information (e.g. delivery address).
    8.2. If we end the contract for these reasons, we may deduct reasonable compensation from any refund.
    8.3. We may withdraw Products from sale at any time and refund payments for undelivered orders.

10. Price and Payment

10.1. Prices (including VAT, where applicable) are shown on the order page.
10.2. If VAT rates change between order and delivery, we will adjust the price accordingly (unless paid in full beforehand).
10.3. If we discover a pricing error:

  • If the correct price is lower, we will charge the lower amount.
  • If higher, we will contact you before accepting your order.
    10.4. We accept all major debit and credit cards.
    10.5. Payment must be received in full before dispatch.

11. Allergens and Dietary Information

11.1. All Products are prepared in a kitchen where allergens are present. While we take great care to minimise cross-contamination, we cannot guarantee that any Product is completely free from allergens.
11.2. Common allergens handled in our kitchen include (but are not limited to): cereals containing gluten, nuts, peanuts, sesame seeds, milk, eggs, soya, mustard, celery, fish, crustaceans, and sulphites.
11.3. It is your responsibility to check the ingredient and allergen information provided on our website or packaging before consuming our Products.
11.4. If you have a food allergy, intolerance, or special dietary requirement, please contact us at help@fusionvalleykitchen.com before placing an order to discuss your needs.
11.5. We accept no liability for any allergic reaction resulting from the consumption of our Products where the allergen was correctly disclosed in our ingredient or allergen information.


12. Our Responsibility for Loss or Damage

12.1. We are responsible for foreseeable loss or damage caused by our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
12.2. We do not exclude or limit liability for death or personal injury caused by negligence, fraud, or breach of your legal rights.
12.3. We supply Products for domestic use only. If used for business, resale, or commercial purposes, we accept no liability for loss of profit, business interruption, or loss of opportunity.


13. How We Use Your Personal Information

13.1. We will use your personal information to:

  • supply Products to you;
  • process payment;
  • send information about similar Products if you consented (you may opt out at any time).
    13.2. We will not share your personal information with third parties except where required by law.

14. Other Important Terms

14.1. We may transfer our rights and obligations under these Terms to another organisation. If you are unhappy with this, you may cancel within one month and receive a refund for undelivered Products.
14.2. You may only transfer your rights under these Terms with our written consent.
14.3. This contract is between you and us. No other person has rights to enforce it.
14.4. If any part of this contract is found unlawful, the remaining parts will remain in effect.
14.5. Even if we delay enforcing this contract, we may still enforce it later.
14.6. These Terms are governed by the laws of England and Wales. You may bring legal proceedings in the courts of England and Wales, Scotland, or Northern Ireland depending on where you reside.
